If you get admitted into a PTI program or pretrial admission, once the prosecutor and the probation department have submitted that recommendation to the judge, the judge can then decide to accept or reject that recommendation. Most of the times the judge will accept it. The judge may set forth certain conditions. You have to get drug treatment, you have to maintain employment, maintain full-time school, maybe you’re subject to a random urine or blood monitoring just to make sure you’re not doing any forbidden substances. They also put a condition on, on you that you are to get no further charges during the period of PTI. The value and the best thing about pretrial intervention is that at the end of that six to 36-month period, the charges will be completely dismissed if, in fact, you comply with all the conditions.
Now if you fail to comply with the conditions of PTI, the case is reopened. So if you were initially charged with aggravated assault or some type of theft offense and you failed to complete the -- PTI, you know, you’re back to square one and you have to face trial on those charges.
