It’s frequently the case when I represent an individual charged with a parry disorderly, person’s offense or non-indictable offense, that resisting arrest charge is also included in the charges. Resisting arrest is a charge that is typically signed against an individual, whenever there is a potential for they are being injured when they are cuffed or their voice displeasure with the manner of which they were arrested or there is an issue of excessive force to protect themselves, the officers usually issue a resisting arrest. In many cases, we can avoid conviction of that offence all together assuming the injuries were not very serious.
