The Fifth Amendment is a provision of the United States Constitution that gives you the right to remain silent. The State cannot compel your testimony. If you’re stopped by the police you’re supposed to be given the Miranda warnings. You have the right top remain silent, anything you say can and will be used against you and so forth. And among those rights are you have a right to remain silent, exercise it. It is a constitutional right, you don’t have to give a statement to the police. Still be polite but you can still tell the officer, I’m going to remain silent per the Fifth Amendment and then you come in and talk to me and then we’ll come up with a strategy from there.
