Clients often come to my office with a traffic ticket and they say, can something be worked out? Legally that’s considered a plea bargain. A plea bargain is entered into by the defendant with the State. The State is represented by the prosecutor. The prosecutor will either go to the defense attorney or if the person is unrepresented to the individual themselves and say, here’s what we’d like to offer you, if you plead guilty we’re going to offer you something better than the original charge.
For instance, if you’re speeding 25 miles an hour above the speed limit, that’s a four point ticket. They may offer you a plea of guilty to doing 10 miles above the speed limit, that lowers your fine and it’s only two points.
So those are plea bargains and they are acceptable under case law and also from the New Jersey Supreme Court has deemed that they’re acceptable. We can enter into a plea bargain on pretty much everything other than drunk driving which is prohibited by statute and also a Supreme Court directive.
